Terms and Conditions for ZATTU PHOTO BOOTH
Welcome to ZATTU PHOTO BOOTH! Firstly, we appreciate you considering our services for your event. Secondly, both of us need to have a clear understanding of the terms and conditions that govern our photo booth rental services. Therefore, please carefully read the following terms and conditions before booking with ZATTU PHOTO BOOTH. These terms and conditions outline the agreement between ZATTU PHOTO BOOTH (hereinafter referred to as “we,” “us,” or “ZATTU PHOTO BOOTH”) and you, the client (hereinafter referred to as “you” or “Client”).
- Booking and Payment
To begin with, all bookings are subject to availability and confirmation by ZATTU PHOTO BOOTH. Subsequently, a booking is considered confirmed only upon receipt of a signed contract and a non-refundable deposit. The deposit amount will be specified at the time of booking. Furthermore, the remaining balance is due [Number] days before the event date. In the event of bookings made within [Number] days of the event date, full payment may be required at the time of booking. We accept payments via [List Accepted Payment Methods, e.g., Credit Card, Bank Transfer, Check]. Moreover, pricing is subject to change without prior notice, but once your booking is confirmed with a deposit, the quoted price will be honoured. However, additional charges may apply for services beyond the original agreement, such as overtime, extra prints, or add-ons requested after booking confirmation.
- Photo Booth Usage and Client Responsibilities
Initially, ZATTU PHOTO BOOTH will deliver, set up, and remove the photo booth at the agreed-upon location and time. During the event, you are responsible for ensuring a safe and suitable environment for the photo booth operation. This includes but is not limited to, providing a level and stable surface, adequate power supply within 20 meters of the setup area, and protection from inclement weather if the event is outdoors. In addition, you are responsible for crowd control and ensuring that guests use the photo booth responsibly and respectfully. For instance, any damage to the photo booth equipment caused by misuse, negligence, or intentional actions of the Client or their guests will be the Client’s financial responsibility. It is also important to note, that while we strive for optimal photo quality, the quality of photos can be affected by factors beyond our control, such as guest behaviour, lighting provided by the venue, and electrical fluctuations. Therefore, ZATTU PHOTO BOOTH is not responsible for photo quality issues arising from these external factors. Ultimately, the Client assumes responsibility for the conduct of their guests around the photo booth and related equipment.
- Space and Setup Requirements
Firstly, to ensure smooth operation, the Client must provide adequate space for the photo booth setup. Generally, we require a space of approximately [Dimensions, e.g., 10ft x 10ft] with a height clearance of [Height, e.g., 8ft]. Secondly, access to a standard [Voltage, e.g., 110V] power outlet within [Distance, e.g., 20 meters] of the setup area is necessary. Thirdly, for outdoor events, the Client is responsible for providing a covered and sheltered area, protecting the photo booth equipment from rain, direct sunlight, and excessive wind. Furthermore, the setup location must be reasonably level and accessible for loading and unloading equipment. Moreover, any parking fees or venue access charges related to setup and removal are the responsibility of the Client, unless explicitly agreed upon in writing. In cases where these space and setup requirements are not met, ZATTU PHOTO BOOTH reserves the right to refuse service and no refund will be provided for the deposit or any payments made. Therefore, please ensure you have verified your venue’s suitability before booking.
- Photo Booth Operation and Downtime
Initially, ZATTU PHOTO BOOTH will make every effort to ensure the photo booth operates smoothly for the duration of the agreed rental period. However, technical malfunctions or unforeseen circumstances may occasionally cause temporary downtime. In such cases, we will make every reasonable effort to rectify the issue promptly. For instance, if downtime occurs, we will extend the rental period to compensate for the lost time, whenever feasible. Alternatively, if an extension is not possible, we may offer a pro-rata refund for the portion of the rental period during which the photo booth was inoperable. Nonetheless, ZATTU PHOTO BOOTH’s liability for any downtime is limited to the options mentioned above and does not extend to consequential damages or losses incurred by the Client due to photo booth downtime. Therefore, while we strive for uninterrupted service, technical issues can sometimes occur despite our best efforts.
- Cancellation and Rescheduling
Regarding cancellations, if the Client cancels the booking, the initial deposit is non-refundable. Additionally, cancellations made within [Number] days of the event date may be subject to further cancellation fees, up to the full contract amount, depending on the specific circumstances and expenses incurred by ZATTU PHOTO BOOTH. On the other hand, if you need to reschedule your event, we will attempt to accommodate your request, subject to availability and a rescheduling fee, which will be determined on a case-by-case basis. However, rescheduling is not guaranteed and is dependent on ZATTU PHOTO BOOTH’s availability on the proposed new date. In any case, all cancellation or rescheduling requests must be submitted in writing via [Email Address or Method]. Ultimately, ZATTU PHOTO BOOTH reserves the right to cancel the booking under extraordinary circumstances, such as equipment malfunction beyond repair, or force majeure events (e.g., natural disasters, pandemics). In such unlikely events, the Client will receive a full refund of all payments made.
- Image Usage and Privacy
Firstly, ZATTU PHOTO BOOTH retains the copyright to all photos taken by our photo booths. However, Clients and their guests are granted personal usage rights for the photos. By utilizing our services, you grant ZATTU PHOTO BOOTH permission to use photos taken at your event for promotional purposes, including but not limited to website galleries, social media, and marketing materials. Nevertheless, we respect your privacy. Therefore, if you or your guests prefer not to have photos used for promotional purposes, please notify us in writing before the event, and we will honour your request. Furthermore, we adhere to all applicable privacy laws and regulations regarding the collection and use of personal data. Rest assured, we will not sell or share your personal information with third parties without your explicit consent, except as required by law.
- Liability and Indemnification
To clarify, ZATTU PHOTO BOOTH’s liability is limited to the services explicitly outlined in the booking contract. We are not liable for any indirect, consequential, or incidental damages arising from the use or inability to use our photo booth services, including but not limited to loss of profits, emotional distress, or damage to reputation. Furthermore, the Client agrees to indemnify and hold harmless ZATTU PHOTO BOOTH, its owners, employees, and contractors from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney’s fees, arising out of or in connection with the Client’s event and the use of the photo booth services, especially concerning injury to persons or damage to property caused by the Client or their guests. In conclusion, our liability is limited to the contractual service provided, and the Client assumes responsibility for the event environment and guest conduct.
- Governing Law
Finally, these Terms and Conditions shall be governed by and construed by the laws of Ontario, Canada, without regard to its conflict of laws principles. Any disputes arising under or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of Canada.
